These terms constitute a legally binding agreement between you and DevPion.
We may modify these Terms of Use from time to time, and it is your responsibility to review them regularly. Your continued use of the Services after such changes constitutes acceptance of the new terms.
DevPion specializes in software development and marketing solutions for businesses and individuals, including but not limited to:
Custom software development for mobile, web, and desktop platforms.
Marketing solutions tailored to enhance brand visibility and customer engagement.
Tech consulting to identify the best tools and strategies for your needs.
Maintenance and updates for software and marketing platforms.
Flexible payment plans, including up to 24 monthly installment payments for projects valued at up to €10,000.
Our goal is to deliver high-quality, innovative, and user-friendly solutions that align with the unique goals of your business. We are committed to providing seamless experiences, from concept to launch, with full transparency and ongoing communication throughout each project.
By using our Services, you agree to the following:
Accuracy of Information: You will provide accurate, current, and complete information during the sign-up and project initiation process. Any changes to your contact details or project requirements must be communicated promptly.
Confidentiality: You agree to maintain the confidentiality of your login credentials and project information. Any unauthorized use of your account or breach of security must be reported immediately.
No Misuse: You will not use the platform for illegal or unauthorized purposes. Misuse includes, but is not limited to, hacking, distributing malware, or engaging in activities that violate intellectual property rights or harm other users.
Violation of these obligations may result in the suspension or termination of your account, and legal action may be pursued if necessary.
All intellectual property rights, including but not limited to trademarks, copyrights, and database rights, related to solutions developed by DevPion, remain the property of DevPion until full payment is made.
Once all payments are settled, ownership of the intellectual property related to custom-developed solutions will be transferred to you. However, DevPion retains the rights to any frameworks, libraries, or pre-existing codebases used during development.
You are prohibited from:
Copying or modifying any part of the developed solutions, their source code, or proprietary tools used in their development.
Creating derivative works based on our intellectual property without explicit written permission.
Reverse-engineering any software or tools provided by DevPion.
Unauthorized use of our intellectual property may result in immediate termination of services and legal consequences.
We offer various payment options to accommodate different client needs. Clients can pay in full upfront or opt for installment plans:
Installment Plans: For projects valued at up to €10,000, we offer installment plans of up to 24 months. These plans are facilitated through third-party payment providers, and terms will be specified during the checkout process.
Milestone Payments: In certain cases, payments may be split into project milestones. Work will commence upon the receipt of the initial deposit, and subsequent payments will be due upon the completion of each milestone.
Late Payments: Failure to meet payment deadlines will result in suspension of services until the outstanding amount is cleared. In the case of installment plans, missed payments may result in the entire outstanding amount becoming due immediately.
In all cases, the terms of payment will be agreed upon in writing before the project begins. No work will commence without a signed contract or written confirmation from both parties.
Our refund and cancellation policy ensures fairness for both parties. The following conditions apply:
Full Refund: A full refund will be issued if a project is canceled before development begins.
Partial Refund: If a project is canceled after development has commenced but before completion, a partial refund may be issued based on the amount of work completed. This will be calculated by deducting the value of the work already delivered from the total contract amount.
Non-Refundable Services: Once the final product has been delivered and accepted, no refunds will be issued. Similarly, services related to maintenance or updates are non-refundable once work has begun.
To request a refund or cancellation, please contact us at hello@devpion.com within 14 days of payment or milestone completion. Refund requests submitted after this period may not be accepted.
DevPion may integrate third-party services into your solutions, such as payment gateways, hosting services, or analytics tools. These services have their own Terms of Use and Privacy Policies, which you must agree to when using them.
We do not control third-party providers and cannot be held responsible for any issues arising from their services. Any disputes regarding third-party services must be resolved directly with the provider.
Examples of third-party services we may integrate include:
Payment gateways (e.g., Stripe, PayPal).
Hosting and cloud storage services (e.g., AWS, Google Cloud).
Analytics tools (e.g., Google Analytics).
DevPion disclaims any liability for downtime, errors, or data loss caused by third-party providers.
DevPion is committed to protecting your privacy and data security. We store and process personal data that you provide to us in order to deliver the services you request. By using our Services, you agree to our collection, use, and storage of your data as outlined in our Privacy Policy.
While we take reasonable precautions to protect your data, you are responsible for keeping your devices and login credentials secure. DevPion will not be held liable for data breaches resulting from negligence or failure to follow security recommendations, such as using strong passwords and enabling two-factor authentication.
We encourage you to regularly update your device’s software and avoid jailbreaking or rooting your device, as this can compromise security features and impact the functionality of your solutions.
DevPion is not responsible for any damages or losses that arise from:
The use or inability to use our Services due to factors outside our control (e.g., internet outages, third-party service failures).
Data loss or corruption due to external factors, including but not limited to, hacking, malware, or user negligence.
Losses incurred due to inaccurate or outdated information provided by third parties.
In no event shall DevPion or its affiliates be liable for indirect, incidental, punitive, or consequential damages, including loss of profits, revenue, or data, even if such losses were foreseeable.
Our liability to you for any claims arising out of the provision of our Services will not exceed the amount you have paid us for those services in the preceding 12 months.
We reserve the right to suspend or terminate your access to our Services for any of the following reasons:
Breach of these Terms of Use or any other agreements with DevPion.
Use of our platform for illegal activities or violation of applicable laws.
Failure to meet payment obligations, including installment plan defaults.
Upon termination:
You will lose access to any ongoing services or projects.
Any intellectual property rights or licenses granted to you will be revoked.
You are required to cease all use of the delivered solutions and delete any associated data from your devices.
These Terms of Use and any disputes arising from them will be governed by the laws of Portugal. Any disputes will be resolved through arbitration in Lisbon, Portugal, or the appropriate courts if arbitration is not agreed upon by both parties.
